A plymouth man accused of robbing and shooting city businessman Colin Pester in April 2008 has lost his legal bid to have the case against him dismissed.
Gary Ball, aged 43, of Beacon Park Road, appeared via video link yesterday from Long Lartin Prison, where he has spent four months on remand. His barrister argued that the Crown Prosecution Service had been ordered to serve details of the prosecution case on the defence by April 1, but the documents contained no evidence against Ball. Additional evidence had arrived, but should be ruled out of time, as it was 10 weeks late, he said.
